National Conveyancing Week: Initial Set-Up

It’s National Conveyancing Week and our Conveyancing team have each written a blog to explain their role in your property transaction.

Starting with Day 1, Isobel Knapman, Administration Assistant, and Amanda Pickman, Legal Assistant, explain how their roles are your first port of call.

I’m Amanda and I am a Legal Assistant within the Conveyancing Team and have been here since August 2021. I’m Isobel and I am the Administration Assistant for the Conveyancing Team. I joined Nash and Co in October 2022. We will usually be the first port of call when you have decided you need to instruct a Lawyer for the sale or purchase of a property.

If you haven’t already obtained a quotation directly from our website, we will ask you some questions in relation to the property and can then provide you with a quote for our fees along with our instruction questionnaire for you to complete and return to us.

We have a mobile conveyancing app which we will ask if you would like to use for the receipt of the initial letters and documents, Source of Funds questionnaire (for a purchase) along with an ID link for you to complete. This speeds up the initial process and means we are not relying on Royal Mail. However, if you would prefer to have these documents sent via email or post, we can have this arranged for you.

Once we have you set up and the initial documents returned along with ID and any initial money on account, we then proceed to check the Source of Funds provided on a purchase. We will need to be provided with bank statements to show where the money, which has been saved, has come from and once we are satisfied, this will be signed off by the lawyer acting on your behalf. We can then proceed to move on to the next stage – which will be waiting for the Contract Pack to be received from the Seller’s Lawyer.

On a Sale file, once we have received your signed Protocol Forms, we will begin to prepare the Draft Contract, obtain the Title Register and any other documents held from the Land Registry and send this over to the buyer’s lawyer along with any supporting documentation such as, EPC, Boiler Service documents, Gas Safety Documents, Electrical Installation Documents and anything else relevant to the property with works that have been carried out.

It is not unusual for things to be quiet whilst we await enquiries from the buyer’s lawyer on a sale as they will be looking to obtain their searches and reporting to their client on the findings.

On a Purchase file once we have received the Contract Pack, we will be looking to obtain your authority to proceed with searches and this is covered by our colleagues, Donna and Beth, here.
